How to Terminate Child Support in Ontario

Payment of child support is not supposed to last forever and is typically only payable as long as the child or children are still entitled to child support.

When child support is payable through the Family Responsibility Office, payment of child support does not automatically end. Child support could be payable past the age of 18 if the child has a disability or is unable to support himself or herself due to being enrolled in a post-secondary education program.

Please contact our office for a consultation as to whether the child or children is still eligible for child support.

If the child is over 18 and independent, it is best to communicate with the child support recipient to reach an agreement as to whether child support should still be payable. If child support is payable through the Family Responsibility Office, an Application to Discontinue Enforcement of Ongoing Support can be submitted to the Family Responsibility Office. The Family Responsibility Office will then contact the child support recipient to confirm with the child support recipient that child support should no longer be paid.

If the child support recipient doesn’t agree that payment of child support should end and child support is enforced through the Family Responsibility Office, it is necessary to submit a motion to change to the court to vary or terminate child support payments.
