Custody and Access

Custody refers to the ability to make decisions on behalf of the child.

Access refers to the ability to see and care for the child.

While custody and access issues can often be highly contentious, the legal test for making custody and access orders is usually the best interests of the child. As such, any parenting plan has to be child focused to ensure that the interests of the child will be met by the parenting plan.
